This report explores swap proposals that are currently being considered inCongress as well as alternatives that have been proposed in the past or which are modifications to those being considered. It reviewed the theoretical basis for dividing responsibilities across different levels of Government and synthesizes the available evidence on the likely behavioral responses of states following a re-ordering of responsibilities. Finally, the report presents an empirical analysis of possible scenarios of the impact of alternative swap proposals across states.

Federalism - a national government of preeminent but limited authority - is a central concept upon which our nation was founded. Although Congress' power to pass laws is limited by the United States Constitution, the United States Supreme Court (hereinafter 'the Supreme Court' or 'the Court') has for the last several decades and until recent decisions given expansive reach to this notion. For example, Congress' power to enact legislation under the Commerce Clause was interpreted broadly. Indeed, the Court's decision in Wickard vs Filburn seemed to leave little outside of the Commerce Clause reach. For many years, this view obtained in challenges to congressional actions under the Commerce Clause. However, the Court has in recent decisions forcefully declared that congressional authority under the Commerce Clause is not boundless.

The articles consist largely of edited reprints from ACIR's quarterly magazine, 'Intergovernmental Perspective.' After an overview of the 1959 to 1979 period, they begin with the election year of 1976 and end with the next to last year of the Reagan administration (1987). In this volume can be found phrases that track the course of intergovernmental relations over the past three decades: creative federalism, revenue sharing, new federalism, block grants, taxpayers revolt, countercyclical aid, and many others. The ideological and administrative considerations underpinning these concepts remain current because the experiments and experiences in domestic policy over the past three decades have redefined the parameters of any debate about the future of intergovernmental relations.

The review focused on the extent to which state and local governments that receive direct federal financial assistance are having the required single audits performed. The review also addressed the adequacy of federal initiatives to ensure that state and local governments required to complete single audits are doing so. Three issues concerning problems in implementing the act as well as the quality and usefulness of single audits conducted will be addressed in a future report. The General Accounting Office found widespread compliance with requirements to have single audits performed for the first complete reporting cycle under the act. (kr)

This capping report draws on a considerable body of work recently done by GAO on election systems. We address three main issues that Congress may wish to keep in mind as it approaches election reform. First, we examine the division of federal and state authority to conduct elections and the resulting variation among election jurisdictions. Second, we describe the challenges that election officials face as they work with the people, processes, and technology involved in our administering our nation's election systems. And third, we suggest four criteria that Congress could use as it weighs the merits of various reform proposals.

In this report, the National Council on Disability (NCD) assesses the nations response to the United States Supreme Courts decision in Olmstead v. L.C., 527 U.S. 581 (1999) that the unjustified institutionalization of people with disabilities is a form of discrimination. NCDs research reports on the extent of unnecessary institutionalization in the United States, the continuing barriers to community placement, and resources and service models that facilitate community integration. NCD examines the Federal Governments implementation efforts and the strategies states and key stakeholders are using to (1) develop consensus on a coordinated action plan, (2) identify and commit the necessary resources for community-based service options, and (3) sustain collaborative action toward creating real choice for people with disabilities living in institutions.
